Third-party litigation funding (TPLF) is reportedly expanding rapidly in the United States. This system allows investors with no direct connection to a legal case to profit from its outcomes. The growth of TPLF, which remains largely unregulated and undisclosed, has been associated with inflated settlement values and rising legal costs that ultimately affect consumers, households, and small businesses.
According to the U.S. Chamber of Commerce Institute for Legal Reform, total tort costs reached $443 billion in 2020. This figure represents 2.1% of the Gross Domestic Product (GDP) or approximately $3,621 per U.S. household. Small businesses bore about $160 billion or 36% of these expenses, leading to higher prices, fewer jobs, and reduced investment opportunities across local economies.
A report by Cornell Law School projected for 2025 highlights that foreign-backed third-party litigation funding has expanded rapidly without transparency or disclosure requirements. The report warns that offshore investors, including sovereign wealth funds, can secretly influence U.S. lawsuits, posing risks to national security, judicial fairness, and economic integrity.
