Johnstown man pleads guilty to stealing funds from federally supported housing program

A Johnstown, Pennsylvania resident has pleaded guilty in federal court to theft from a program receiving federal funds. The announcement was made by First Assistant United States Attorney Troy Rivetti.

Brett Smith, 41, admitted guilt to one count before United States District Judge Stephanie L. Haines on October 1, 2025. According to information presented in court, Smith previously managed an apartment complex for the elderly in Johnstown. While serving as manager, he deposited rental payments and laundry machine coins from the property into his personal bank account. The apartment complex receives funding from the U.S. Department of Housing and Urban Development (HUD) through Section 8 Housing Assistance Payments.

Judge Haines set sentencing for February 3, 2026. Smith faces a maximum sentence of up to ten years in prison and a fine of $250,000 or another amount determined by law. The actual sentence will depend on the seriousness of the offense and any prior criminal history under federal Sentencing Guidelines.

Assistant United States Attorney Nicole A. Stockey is prosecuting the case for the government.

The investigation that led to Smith’s prosecution was conducted by the HUD Office of Inspector General and the Federal Bureau of Investigation.
