Mexican man sentenced for illegal reentry in Montana federal court

A Mexican national, Marco Antonio Contreras-Delira, was sentenced to time served—31 days—for illegal reentry into the United States and has been remanded to the U.S. Border Patrol, according to U.S. Attorney Kurt Alme.

Contreras-Delira, 40, pleaded guilty in November 2025 to one count of illegal reentry. Chief U.S. District Judge Brian M. Morris presided over the case.

According to court documents, law enforcement encountered Contreras-Delira and two others on November 14, 2025, in a vehicle near Froid, Montana. All three individuals presented Mexican identification and admitted they were in the country illegally.

Contreras-Delira was taken to the Plentywood Border Patrol Station for processing. Authorities confirmed he had previously received several final orders of removal and had been removed from the United States once before.

Records show that Contreras-Delira was issued a final order of removal on December 28, 2007, and was removed from the country in December 2009. At his arrest in 2007, he had an active warrant; after paying his fine he absconded to Texas where he was later arrested again. He also has a prior conviction for driving under the influence of alcohol from February 1, 2004, in Bartow County, Georgia.

During an interview with Border Patrol agents on November 14, Contreras-Delira confirmed his Mexican citizenship and stated he did not have documents permitting him to enter or remain in the United States. There is no record that he ever applied for or obtained permission from Homeland Security to reenter.

The U.S. Attorney’s Office prosecuted this case with investigations conducted by the U.S. Border Patrol and Roosevelt County Sheriff’s Office.
