Guatemalan national sentenced for assaulting federal officers during Marlborough immigration arrest

A Guatemalan national has been sentenced to eight months in prison for assaulting federal officers during an immigration arrest in Marlborough, Massachusetts. Guido Andres Cuellar Batres, 24, received the sentence from U.S. District Court Judge Angel Kelley and will also serve one year of supervised release. After completing his sentence, Cuellar faces deportation.

Cuellar pleaded guilty in October 2025 to charges of forcibly assaulting, resisting, opposing, impeding, intimidating, or interfering with federal officers performing their official duties. He was indicted by a federal grand jury on July 17, 2025.

Authorities reported that Cuellar had overstayed his non-immigrant visa by more than four years and was subject to an outstanding immigration warrant. On May 4, 2025, at approximately 9:45 a.m., three Immigration and Customs Enforcement (ICE) officers and a Drug Enforcement Administration (DEA) agent conducted surveillance in a parking lot where they observed Cuellar as a passenger in a vehicle.

The officers approached the vehicle wearing clothing identifying them as law enforcement and ordered Cuellar to exit the car in both English and Spanish. When he refused and did not comply with orders to unlock the vehicle or keep his hands visible—prompting concerns he might be reaching for a weapon—the officers broke a window to gain entry.

After being removed from the vehicle, Cuellar resisted handcuffing efforts. During the struggle, he attempted to bite one officer’s leg, bit another above the wrist, and struck that officer multiple times in the head. Even after being handcuffed, Cuellar continued to resist as agents tried to secure him in their vehicle; he repeatedly jumped to avoid being placed inside. One officer entered from the opposite side to assist when Cuellar head-butted him and spat into his eyes and face.
