Felon sentenced to prison for possessing modified Glock pistol after being found unconscious

Andre Foster, a 49-year-old resident of the District of Columbia with a prior felony conviction, was sentenced to 15 months in federal prison for possessing a modified Glock 19 pistol capable of fully automatic fire. The sentencing took place in U.S. District Court and was announced by U.S. Attorney Jeanine Ferris Pirro.

Foster had previously pleaded guilty on October 24, 2025, before Judge Amy Berman Jackson to one count of felon in possession of a firearm and ammunition. In addition to his prison term, he will serve three years of supervised release.

According to court documents, Metropolitan Police officers and emergency workers responded on April 15, 2025, to the 2500 block of Sheridan Road, SE, after receiving a report about an unconscious man on the sidewalk. While EMT personnel provided aid and Foster regained consciousness, officers noticed a firearm sticking out from his right-side jacket pocket. The weapon was identified as a Glock19 9mm handgun loaded with a 17-round extended magazine containing 14 rounds and one round in the chamber. The gun had been modified with a device known as a “giggle switch,” allowing it to operate as a machine gun.

Foster’s previous conviction for attempted distribution of cocaine resulted in a sentence of three-to-nine years in Superior Court. Due to this felony conviction, he was legally barred from possessing any firearms.

The investigation into this case was conducted by the Metropolitan Police Department with support from the Bureau of Alcohol, Tobacco, Firearms, and Explosives Washington Field Office. Assistant U.S. Attorney Peter V. Roman prosecuted the case.
