U.S. Senate Democratic Whip Dick Durbin, Ranking Member of the Senate Judiciary Committee, said on Mar. 10 that President Trump’s decision to remove U.S. Department of Homeland Security Secretary Kristi Noem followed what he described as a period of mismanagement and controversial enforcement actions under her tenure.

The issue is significant because the Senate Judiciary Committee plays a key role in overseeing federal law enforcement and upholding constitutional protections, according to the official website. The committee's legislative and oversight duties affect public safety nationwide.

Durbin recounted that Secretary Noem had avoided appearing before the committee for nearly a year before testifying last week. “For the first time [during this administration], the Secretary of the Department of Homeland Security came and appeared before the Senate Judiciary Committee. She had been in the position for almost a year and had never agreed to publicly appear and account for her mismanagement of that Department until last week,” Durbin said.

He criticized Noem’s handling of immigration enforcement, referencing incidents where American citizens and legal residents were detained without due process. “Under Kristi Noem’s disastrous stewardship, the Department was devoid of any moral compass or respect for the rule of law... These officers detained American citizens, green card holders, and community members with no prior criminal records, in violent and indiscriminate and unconstitutional roundups,” Durbin said.

Durbin also addressed specific cases involving violence by federal agents during these operations. He stated: “Her roving patrols shot a Chicago resident and citizen, Marimar Martinez, five times... But Renee Good and Alex Pretti in Minneapolis were shot by immigration agents there and did not survive.”

He called for reforms at DHS to ensure federal agents are held to standards similar to local police: “We’re trying to establish a standard for these enforcement officers that is comparable to the standard of your police and state troopers and deputy sheriffs. That’s it,” Durbin said.

Durbin further alleged that Secretary Noem lied under oath about DHS compliance with court orders during her testimony before Congress. He pointed out that her spending on self-promotional campaigns contributed to her loss of confidence from President Trump: “What was the tipping point? Well, it turned out she had a multimillion dollar, in fact, over $143 million, self-promotional campaign which showed Kristi Noem riding horses at Mount Rushmore...”

Looking ahead, Durbin emphasized that Senator Markwayne Mullin has been nominated as Noem's successor but must be confirmed by the Senate: “We will find out how he plans to lead the Department at this perilous moment...”

The Senate Judiciary Committee serves as a standing committee with authority over judicial matters; it is led by a chair who oversees meetings attended by senators from both major parties according to its official website. The committee influences civil rights through its oversight responsibilities based in Washington D.C., exerting influence on federal law across the nation.

Durbin concluded his remarks with questions about future reforms at DHS: “It won’t be unreasonable to ask Senator Mullin if he pursues this appointment by the President what he will do to change this Department... What does he think about shooting innocent Americans in the street? What does he think about his officers wearing masks?...”
