Guatemalan national indicted for illegal re-entry after previous deportation

Emner Isaias Najera-Najera, a 41-year-old native of Guatemala, was indicted on March 19 for illegal re-entry of a removed alien, according to a March 25 announcement by U.S. Attorney David I. Courcelle.

The case highlights ongoing efforts to address unauthorized entry into the United States and is part of broader federal initiatives targeting immigration-related offenses.

According to the charging document, Najera-Najera was found in the United States on March 12 after previously being deported on June 22, 2017. Authorities allege that he reentered without authorization from the Attorney General.

If convicted, Najera-Najera faces up to two years in prison, a fine of up to $250,000, up to one year of supervised release, and a mandatory special assessment fee of $100 for illegal re-entry. "An indictment is merely a charge and that the guilt of the defendant must be proven beyond a reasonable doubt," Courcelle said.

This prosecution falls under Operation Take Back America—a nationwide initiative that uses resources from the Department of Justice’s Organized Crime Drug Enforcement Task Forces and Project Safe Neighborhoods. The operation aims to combat illegal immigration and related criminal activity.

Courcelle praised the U.S. Border Patrol for its investigative work in this matter. Assistant United States Attorney Carter K.D. Guice Jr., from the General Crimes Unit, is handling the prosecution.
