A Brazilian national serving a two-year sentence at the Middlesex House of Correction has been charged with unlawfully reentering the United States after deportation, federal authorities announced on Apr. 2.
The case involves Jose Antonio Ramos, 51, who was indicted by a federal grand jury on one count of unlawful reentry of a deported alien. Ramos is currently incarcerated for Operating Under the Influence (4th or greater offense) and is scheduled to make his initial appearance in federal court in Boston on April 8.
Charging documents state that Ramos was previously removed from the United States in November 2008. The indictment alleges he returned without authorization, which is prohibited under federal law.
If convicted, Ramos faces up to ten years in prison, three years of supervised release, and a fine up to $250,000. He would also be subject to deportation upon completion of any imposed sentence. Sentencing decisions will be made by a federal district court judge based on U.S. Sentencing Guidelines and applicable statutes.
United States Attorney Leah B. Foley and David T. Wesling, Acting Field Office Director of U.S. Immigration and Customs Enforcement’s Enforcement and Removal Operations in Boston announced the charges. Assistant U.S. Attorney Jennifer Zacks from the Major Crimes Unit will prosecute the case.
Authorities emphasized that all details contained in charging documents are allegations and that Ramos is presumed innocent unless proven guilty beyond a reasonable doubt.
