U.S. Senate Democratic Whip Dick Durbin, Ranking Member of the Senate Judiciary Committee, released a Government Accountability Office (GAO) report on Apr. 10 detailing the Food and Drug Administration (FDA) and Department of Justice’s (DOJ) response to unauthorized e-cigarettes. The report examines how these agencies have handled enforcement against thousands of kid-friendly flavored vaping products that are being sold illegally.
The issue is significant because many unauthorized e-cigarette products remain available despite laws requiring FDA authorization before entering the market. According to Durbin, "The law is clear that e-cigarettes must obtain FDA authorization to enter the market, yet thousands of vapes are unlawfully and brazenly sold in stores and online by retailers nationwide. This GAO report helps shed light on FDA and DOJ’s failure to protect children from a lifetime of nicotine addiction. Despite court mandates and congressional deadlines, thousands of dangerous, kid-friendly e-cigarettes are still on the market illegally." He also said, "FDA and DOJ must use their enforcement tools instead of cowering to the tobacco industry. The health of our kids depends on it."
The GAO found that while only 39 e-cigarette products were legally allowed at the time, about 6,000 unauthorized ones were being sold illegally—yet since Fiscal Year 2022, DOJ has taken civil or criminal action in only 88 cases. The report highlights that most illegal products remain unaddressed by federal enforcement efforts.
Further findings show that DOJ resources meant for tobacco product enforcement were redirected toward immigration priorities in early 2025; its Consumer Protection Branch was disbanded later that year. Additionally, there is no formal written process guiding how DOJ should prioritize referrals from FDA regarding noncompliant manufacturers or sellers.
Despite these challenges, a joint task force between FDA and DOJ led to three major seizures between October 2024 and September 2025 which removed seven million illicit vaping devices from circulation.
