OConnor, Assistant Attorney General for the Tax Division, U.S. Department of Justice; and Nancy Jardini, Chief, IRS Criminal Investigation; announced today that on Sept. 24, 2004, at the federal courthouse in Brooklyn, New York, U.S. District Court Judge John Gleeson sentenced William Felcon to 15 months imprisonment, to be followed by two years supervised release. Felcon was also fined $4000, ordered to pay a $100 special assessment, and required to pay restitution to the IRS in the amount of $506,156. In imposing sentence, Judge Gleeson called the defendants conduct just another form of stealing and told the defendant that by committing the crime he had brought a terrible tragedy upon his family.
On Dec. 11, 2002, an indictment was returned charging Felcon, 47, of New Hyde Park, New York, with two counts of willfully filing fraudulent corporate income tax returns on behalf of Star Flite Construction, Inc. and one count of willfully failing to file a corporate income tax return. Star Flite Construction was a drywall subcontractor in New York City. On May 21, 2004, Felcon pled guilty to the felony charge of willfully filing a fraudulent corporate income tax return.
Assistant Attorney General Eileen J. OConnor thanked Tax Division Trial Attorney James Chapman, who prosecuted the case. She also thanked the special agents of the Internal Revenue Service, whose assistance was essential to the successful investigation and prosecution of the case.
