Reaction Of Sen. Barbara Boxer

To Two Environmental Decisions

Released by the Supreme Court Today

Senator Barbara Boxer (D-Calif.), Chairman of the Senate Committee on Environment and Public Works, said: “This is a banner day for the environment, as the Supreme Court decided two cases squarely on the side of protecting the environment and public health. First the court rebuked the Administration for its claim that greenhouse gas emissions cannot be regulated under the Clean Air Act. The Supreme Court specifically recognized the authority of the federal government to limit emissions of these major pollutants."

“In another important victory for public health, the Supreme Court found that old power plants must control increases in noxious air pollution when those plants are modified. I call on the Bush Administration to pursue strong enforcement against plants that do not comply with the Clean Air Act requirements that are so important to protecting our families and communities."

Senator Boxer will issue further statements on the committee's response to these cases.
