EPA fines Kansas cleaning products company nearly $145,000 for violating Clean Air Act’s Risk Management Plan Rule

The U.S. Environmental Protection Agency has fined a Kansas-based cleaning products manufacturer Fuller Industries Inc. for violations of the federal Clean Air Act’s Risk Management Plan Rule.

According to the press release, Fuller Industries will pay the EPA a total of $144,924 in penalties to resolve violations to CAA’s Risk Management Plan Rule.

"The Clean Air Act’s Risk Management Plan Rule regulations require facilities that use regulated toxic and/or flammable substances to develop a Risk Management Plan," according to the press release.

The EPA inspected the company in 2019 and found that the company neglected to comply with various prevention requirements including failure to develop adequate standard operating procedures and piping inspection procedures and failing to conduct certain safety reviews. The company was also found to be in violation of various hazard assessment and recordkeeping requirements.

Under the EPA's Clean Air Act’s Risk Management Plan Rule, facilities that use regulated toxic and/or flammable substances are required to develop a Risk Management Plan. 

The Risk Management Plan implements Section 112(r) of the amended Clean Air Act of 1990. Plans must be revised/updated and resubmitted to the agency every five years.

Approximately 150 accidents occur each year at regulated facilities as a result of companies improperly managing risks.
