Following an investigation that found that Red Lion Home Care Inc. had withheld over $1.4 million in wages, the agency has been ordered by Pennsylvanian federal court to pay over $2.8 million in back wages and damages.
The investigation was conducted by the U.S. Department of Labor’s Wage and Hour Division, litigated by the Solicitor of Labor Seema Nanda. The investigation found that Red Lion Home Care had failed to properly pay 491 of its employees. The agency withheld proper wages by paying its workers the standard rate during the many hours when they worked overtime. The agency would also fail to complete timesheets that would determine accurate pay.
“Since the start of the pandemic, home care workers have been among the millions of workers who provide essential services while putting themselves at-risk,” said Secretary of Labor Marty Walsh.
Nanda says that the ruling will ensure that healthcare workers will receive the hard-earned pay that they're owed.
In addition to the $1.4 million in back wages, Red Lion Home Care has been ordered to pay an equal amount in liquidated damages and a penalty of $251,637.
Red Lion Care is a non-medical home care agency that offers personal assistance services.
