The U.S. Department of Labor (DOL) recently recovered wages from a Florida restaurant after it failed to pay employees overtime wages they earned.
According to a press release issued by the DOL, the Miramar Beach restaurant, Mezcal Mexican Grill, withheld overtime pay from 30 of their bartenders and servers.
A total of $47,088 was recovered for the employees, the release said.
“Employers who use staffing agencies to provide workers and then continue to control and manage them are responsible for ensuring they are paid as the law requires,” Wage and Hour Division District Director Wildalí De Jesús said in Orlando.
The DOL’s Wage and Hour Division has established a toolkit to help quick-service restaurants comply with labor laws, according to DOL officials.
The toolkit contains various fact sheets that explain labor laws as described by the Fair Labor Standards Act and the Wage and Hour Division.
“This case should remind other restaurant employers to review their pay practices and employment relationships," De Jesús said, according to the release. "We encourage employers, workers, and staffing companies to contact the Wage and Hour Division with questions.”
