United States Attorney Brendan V. Johnson announced that a Fort Thompson, South Dakota, man convicted of Assault with a Dangerous Weapon was sentenced on Aug. 26, 2013, by U.S. District Judge Roberto A. Lange.
Myron Touche, Sr., age 44, was sentenced to 22 months of imprisonment, 18 months of supervised release, and a $100 special assessment to the Federal Crime Victims Fund.
Touche was indicted by a federal grand jury on Feb. 13, 2013. He pled guilty to the above charge on June 4, 2013.
The charge stems from an incident occurring on Nov. 10, 2012, wherein Touche ended up at the trailer house of his niece and her boyfriend. Two individuals were arguing in the back bedroom, and Touche went to the back room and confronted the two arguing. Touche then grabbed a gun that was by the front door and pointed it at the victim. The victim and another individual were able to wrestle the gun away from Touche.
The investigation was conducted by the Federal Bureau of Investigation. Assistant U.S. Attorney Meghan N. Dilges prosecuted the case.
Touche was immediately turned over to the custody of the U.S. Marshals Service.
