BUFFALO, N.Y. -- U.S. Attorney William J. Hochul, Jr. announced today that Jordan Warunek, 22, of Lancaster, N.Y., pleaded guilty to conspiracy to possess with intent to distribute and to distribute fentanyl and was sentenced to two years probation by U.S. District Judge Richard J. Arcara.
Assistant U.S. Attorney Mary Catherine Baumgarten, who is handling the case, stated that between September, 2012 and December 2012, the defendant conspired with others to distribute fentanyl, oxymorphone, and oxycodone, Schedule II controlled substances. During the conspiracy, Warunek purchased 100 mcg fentanyl patches from co-defendant Barbara Moran, which he then sold to an undercover officer on November 30 and Dec. 3, 2012. In addition, the defendant purchased oxymorphone and oxycodone from Barbara Moran. Warunek sold the oxymorphone to an undercover officer on Sept. 20, 2012 and the oxycodone to an undercover officer on December 9, 2012.
The plea and sentencing are the culmination of an investigation on the part of the Drug Enforcement Administration, under the direction of Special Agent in Charge James J. Hunt, New York Field Division and the Cheektowaga Police Department, under the direction of Chief David Zach.
Barbara Moran, Mary Moran and Gregory Pendziwiatr have all been convicted of similar charges and are awaiting sentencing.
