ROCHESTER, N.Y.- U.S. Attorney James P. Kennedy, Jr. announced today that Sean Humby, 31, of Rochester, NY, pleaded guilty before Chief U.S. District Judge Frank P. Geraci, Jr. to possession of child pornography involving prepubescent minors. The defendant was previously convicted of sexual abuse of a child and as a result faces a mandatory minimum penalty of 10 years in prison, a maximum penalty of 20 years, a lifetime period of supervised release, and a $250,000 fine.
Assistant U.S. Attorney Kyle P. Rossi, who is handling the case, stated that in 2008, Humby was convicted of sexually abusing three minors in Monroe County and sentenced to serve 108 months in prison. The defendant was released on parole in 2016. On Aug. 24, 2018, New York State Parole Officers conducted a routine search of Humby’s residence, during which they discovered the defendant with a cellular phone, in violation to his parole conditions. Humby was taken into custody. A forensic analysis determined that the cell phone contained child pornography.
The plea is the result of an investigation by the FBI's Child Exploitation Task Force, under the direction of Special Agent-in-Charge Gary Loeffert, and the New York State Division of Parole, under the direction of Acting Commissioner Anthony J. Annucci.
Sentencing is scheduled for Jan. 31, 2019, before Judge Geraci. #
