LAS VEGAS - The Bureau of Land Management (BLM) Las Vegas Field Office, is seeking public comment on a proposal for a Non-competitive Direct Sale and Release of Reversionary Interest, Clark County, NV.
Under the authority of the Recreation and Public Purposes (R&PP) Act, on Oct. 20, 2006, a Partial Title Transfer and Change in Use of 2.5 acres of public land was transferred to the Chabad Hebrew Center for their use as a synagogue, social hall, classrooms, and offices. The transfer document contains a reversionary clause which returns title to the United States if the purchaser transfers title or control to another or if the lands have been devoted to a use other than that for which the lands were conveyed. The Chabad Hebrew Center would like to install a cell tower to support the synagogue, classrooms and surrounding local businesses.
Currently, if a cell tower was installed, the land would revert back to the United States, since it is inconsistent with the R&PP Act and the purpose for which the land was intended. A direct sale of the reversionary interest in the existing 2.5 acre parcel of land purchased from the BLM would allow the Chabad Hebrew Center to use the land for other purposes, like a cell tower.
The Notice of Realty Action for a non-competitive direct sale of the reversionary interest was published in the today Federal Register. Interested parties may submit comments regarding the direct sale of the reversionary interest, whether the direct sale is consistent with local planning and zoning, whether the land is physically suitable for the proposal or if the direct sale is consistent with State and Federal programs. Public comments will be accepted for 45 days until July 28, 2014.
