The U.S. Solicitor General responded to a Supreme Court request, saying Texas and Florida social media laws require Supreme Court review. Notably, the Computer and Communications Industry Association (CCIA) and NetChoice are actively challenging these statutes on the grounds of the First Amendment, which safeguards against governmental intrusion into the realm of free speech, according to an Aug. 14 news release.
"For 200 years, courts have upheld the First Amendment to protect citizens and private businesses from government attempts to compel speech," CCIA President Matt Shurers said in the release. "We look forward to being heard on this matter in the Supreme Court."
Solicitor General Elizabeth Prelogar agrees these laws, which restrict social media companies' content moderation, raise First Amendment concerns, and the Supreme Court will soon decide whether to hear the cases, the release reported.
These challenges have already yielded court orders that effectively stall the implementation of these laws. The forthcoming deliberations of the Supreme Court will center on the determination of whether to formally address these cases, the release said.
The CCIA, with a history spanning more than 25 years, has consistently championed the cause of free expression in the digital realm. This advocacy underscores the First Amendment rights of private enterprises to discern the appropriateness of content within their respective online communities, the release reported.
"We are glad to see the Solicitor General confirm the importance of the First Amendment issues raised by these state laws," Schruers added, according to the release. "This is exactly the sort of case we would expect the Supreme Court to take up, because it involves a key Constitutional issue and split appellate court decisions."
