League of Women Voters files lawsuit alleging AI-generated robocalls in New Hampshire suppressed votes

The League of Women Voters of the United States (LWV), in conjunction with the LWV of New Hampshire and individual New Hampshire voters, has initiated a federal lawsuit against Steve Kramer, Lingo Telecom, LLC, and Life Corporation. The plaintiffs accuse Kramer and Lingo Telecom of employing intimidation, coercion, and deception to suppress voters ahead of the 2024 New Hampshire presidential primary.

According to an LWV press release, the lawsuit was filed in the U.S. District Court District of New Hampshire. It alleges that Kramer, Lingo Telecom, and Life Corp. illicitly used robocalls powered by artificial intelligence (AI) to suppress votes during the primary. The plaintiffs are requesting that the court order the defendants to cease their alleged illegal, dishonest, and deceptive tactics across the nation.

The LWV press release also states that this robocall activity commenced two days prior to the New Hampshire presidential primary. An AI-generated version of President Joe Biden’s voice—also known as deep fake audio—was used in these robocalls to urge voters not to participate in the primary but instead "save" their vote for the November 2024 U.S. Presidential Election. "These deceptive robocalls attempted to cause widespread confusion among New Hampshire voters," Tentarelli said in the press release.

A press release issued by the Federal Communications Commission (FCC) provides further context. On February 6, 2024, it states that FCC’s Enforcement Bureau sent a cease-and-desist letter to Texas-based Lingo Telecom. The letter demanded an immediate halt to supporting "unlawful robocall traffic" on its networks. Earlier in January, an FCC-initiated investigation found that Lingo Telecom had facilitated these controversial robocalls on behalf of Life Corp.

"The use of artificial intelligence to discourage voters from participating in elections is an egregious action which must be stopped," Stewart stated in the same press release.
