Warrantless surveillance under Section 702 of the Foreign Intelligence Surveillance Act (FISA) captures the private communications of many Americans, but the total number affected remains unrecorded. For more than ten years, members of Congress and civil society organizations have urged the Intelligence Community to release an estimate of how many Americans are impacted by this surveillance system. With FISA Section 702 set to expire in 2026, obtaining more information on its effects is crucial. This has led CDT and over 20 other civil society groups to send a letter to the Director of National Intelligence, urging her to develop and disclose this data.
