The United States Environmental Protection Agency (EPA) has issued an Administrative Order on Consent to the Mountain Top Public Service District (MTPSD) in West Virginia. This action follows several violations of the Clean Water Act identified at MTPSD's three domestic wastewater treatment systems located in Bayard, Gormania, and Elk Garden.
An inspection conducted on December 7, 2022, revealed that MTPSD exceeded discharge limits specified in its permit. These excess discharges into the North Branch of the Potomac River were noted as violations; however, they did not pose any immediate threat to residents or water safety. Additional issues concerning operations, maintenance, and reporting data at the plants will be addressed through corrective actions. The MTPSD is reportedly cooperating with the EPA to ensure compliance.
The EPA is collaborating with the West Virginia Department of Environmental Protection to guarantee that MTPSD submits a corrective action plan within a 120-day deadline as mandated by the order.
