New York is set to expand workers' compensation coverage for mental stress to all employees starting in 2025. This change allows workers to file claims for specific mental injuries resulting from "extraordinary work-related stress."
Previously, such claims were restricted to first responders, including police officers, firefighters, EMTs, paramedics, and emergency dispatchers. The initial version of the legislation was expected to lead to a significant increase in workers' compensation claims for "mental stress," which would have raised premiums for employers. However, substantial changes were made by the Governor before signing the legislation. These amendments aim to cover fewer instances of "mental stress," thereby reducing the potential impact on workers' compensation premiums.
Further details will be provided once the amended legislation is passed.
