Following the recent decision by the Sixth Circuit Court of Appeals regarding Title II, the Information Technology and Innovation Foundation (ITIF) has issued a statement. The ITIF is recognized as a leading think tank in science and technology policy.
Joe Kane, Director of Broadband and Spectrum Policy at ITIF, commented on the ruling: "The Sixth Circuit's ruling is a clear victory for consumers and innovation. The court’s decision to strike down the FCC’s Title II Order heads off an ill-suited regulatory regime that would have been a drag on the growth and development of the Internet."
Kane further explained that treating broadband like an old telephone monopoly would not have promoted a free and open Internet. Instead, he argued it could have jeopardized progress that has resulted in unprecedented connectivity, speeds, and choice for consumers over decades.
With this ruling providing clarity that Title II is not suitable for regulating the Internet, Kane suggested that the new FCC Chairman should focus on policies beneficial to consumers rather than engaging in partisanship.
