The Federal Trade Commission (FTC) has finalized a consent order mandating Guardian Service Industries, Inc. to cease enforcing its no-hire agreement. This decision follows allegations made by the FTC in December 2024, claiming that Guardian's agreement restricted building owners and competing contractors from hiring its employees. The agreement reportedly limited employees' ability to seek better wages and conditions.
Under the new order, Guardian is required to stop enforcing these agreements and refrain from suggesting any such limitations exist to potential or current clients.
After a period for public comments, the commission approved the final order with a narrow 3-2 vote. Commissioners Holyoak and Ferguson expressed dissent.
