Mexican man sentenced for possessing child pornography after border inspection

Alamdar Hamdani U.S. Attorney | U.S. Attorney for the Southern District of Texas

A Mexican citizen has been sentenced to 60 months in federal prison for possession of child pornography, according to acting U.S. Attorney Jennifer B. Lowery. Kevin Alejandro Santos-Moya, aged 22, pleaded guilty on May 30, 2024.

U.S. District Judge Fernando Rodriguez Jr. handed down the sentence and ordered Santos-Moya to pay $3,000 in restitution to a known victim. After completing his prison term, he will serve ten years on supervised release with conditions restricting his access to children and the internet. Additionally, Santos-Moya will be required to register as a sex offender.

The case dates back to June 30, 2023, when Santos-Moya attempted entry into the United States via the Los Indios Port of Entry. During a secondary inspection by law enforcement officers, a search of his iPhone revealed child sexual abuse material (CSAM). Forensic analysis uncovered a total of 31 images and 37 videos depicting CSAM.

Santos-Moya is currently in custody awaiting transfer to a U.S. Bureau of Prisons facility.

The investigation was conducted by Homeland Security Investigations with Assistant U.S. Attorney Ana C. Cano prosecuting the case under Project Safe Childhood (PSC). This initiative was launched by the Department of Justice in May 2006 to address child sexual exploitation and abuse nationwide by coordinating federal, state, and local resources.
