Delaware County man faces indictment for alleged Social Security fraud

Brian Gill, a 59-year-old resident of Andes, New York, has been indicted on charges of Social Security fraud. The indictment alleges that Gill concealed his work activity at a tree service company he owned while receiving disability benefits from the Social Security Administration.

The announcement was made by United States Attorney Carla B. Freedman and Amy Connelly, Special Agent in Charge of the Social Security Administration's Office of the Inspector General for the New York Field Office.

The charge of Social Security fraud carries a potential maximum sentence of five years in federal prison, a fine up to $250,000, and up to three years of supervised release. Additionally, Gill could be required to pay restitution for the funds he allegedly collected fraudulently. Sentencing will be determined by a judge based on applicable statutes, U.S. Sentencing Guidelines, and other considerations.

It is important to note that these charges are accusations at this stage. Brian Gill is presumed innocent until proven guilty in court. The case is being investigated by the Social Security Administration's Office of the Inspector General and prosecuted by Special Assistant United States Attorney Paul Tuck.
