A federal grand jury has indicted a 33-year-old Mexican citizen for illegal reentry into the United States following a prior removal, according to U.S. Attorney Nicholas J. Ganjei. Hector Salvador Lozano-Davila is currently in custody and is expected to face arraignment before a U.S. magistrate judge soon.
The criminal complaint states that authorities encountered Lozano-Davila near Roma on January 11. He allegedly entered the United States from Mexico on that date. A records check revealed that Lozano-Davila was previously convicted of sexual assault of a child in 2019 and was removed to Mexico in November 2021.
If found guilty, Lozano-Davila could face up to 20 years in federal prison and a potential fine of $250,000.
The investigation was conducted by Border Patrol, with Assistant U.S. Attorney Laura Garcia prosecuting the case.
It is important to note that an indictment is merely a formal accusation of criminal conduct and not evidence of guilt. A defendant remains presumed innocent unless proven guilty through due process of law.
