Bailey Burger, a 38-year-old resident of Chazy, New York, has been indicted for his alleged involvement in alien smuggling. The indictment includes one count of conspiracy to commit alien smuggling for profit and four additional counts of alien smuggling for profit. These charges stem from an incident on January 26, 2025, where Burger is accused of smuggling four Indian citizens into the United States.
The announcement was made by United States Attorney Carla B. Freedman and Chief Patrol Agent Robert N. Garcia of the United States Border Patrol's Swanton Sector. It is important to note that the charges in the indictment are accusations at this stage, and Burger is presumed innocent until proven guilty.
If found guilty on all charges, Burger could face a prison sentence ranging from five to fifteen years and a minimum of three years of supervised release following imprisonment. Sentencing would be determined by a judge considering relevant statutes, U.S. Sentencing Guidelines, and other factors.
Burger appeared before United States Magistrate Judge Gary L. Favro in Plattsburgh today for arraignment and will remain detained pending a hearing scheduled for February 20.
