Former Western New York man admits lying during fraud trial

Michael W. Luehrsen, a 41-year-old resident of Miami, Florida, has pleaded guilty to perjury charges in the U.S. District Court for the Western District of New York. The plea was announced by Acting U.S. Attorney Joel L. Violanti and comes with a maximum penalty of five years imprisonment. Additionally, Luehrsen has agreed to pay approximately $2 million in restitution and to forfeit about $2 million in assets.

The case is being handled by Assistant U.S. Attorneys Charles M. Kruly and Grace Carducci. During a February 2022 jury trial, Luehrsen testified under oath regarding his whereabouts on specific dates related to the case:

"Q. Mike, I want to start by talking about your dad. You told Mr. Kruly that on the days that those prescriptions were faxed you were not in town, is that what you said?

A. That’s correct.

Q. Can you tell the jury, where were you?

A. On June 27, 2014, I was actually in California visiting Cornerstone Pharmacy with two physicians. On July 11, of 2014, I was in Boston, Massachusetts.

Q. And how do you remember that?

A. I have photographs from my phone showing me in those particular cities."

However, evidence from Luehrsen's cell phone contradicted his testimony and showed he was actually in Buffalo on July 11, 2014. Further records corroborated his presence there at the time when an altered compound prescription form was faxed from his father's home.

This false testimony occurred during Luehrsen's trial for conspiring to commit healthcare fraud among other charges—making it a material matter whether he was indeed present in Buffalo on that date.

The investigation leading to this plea involved efforts by the Federal Bureau of Investigation under Special Agent-in-Charge Matthew Miraglia's direction.

Luehrsen is scheduled for sentencing before Judge Lawrence J. Vilardo on June 27, 2025.
