Illegal immigrant sentenced for reentry into the U.S. in Alabama

Sean P. Costello U.S. Attorney | U.S. Attorney for the Southern District of Alabama

Juan Carlos Ruiz-Agustin, 33, has been sentenced for illegal reentry into the United States. Court documents revealed that Ruiz-Agustin was arrested by the Foley Police Department on January 24, 2025, for drunken driving. The arrest raised the suspicion that he was not a U.S. citizen, leading to contact with the Immigration and Customs Enforcement (ICE). It was determined by ICE that Ruiz-Agustin had been previously removed from the U.S. twice in 2012, once in 2013, and again in 2015. His criminal record includes convictions for illegal entry in 2012 and illegal reentry in 2015.

In the courtroom, Chief Judge Beaverstock imposed a sentence of time served and a one-year term of supervised release following Ruiz-Agustin's future release. Since his arrest, Ruiz-Agustin has remained in custody. Upon his release, he will be referred to immigration for deportation proceedings. A special assessment of $100 was also ordered.

The announcement was made by U.S. Attorney Sean P. Costello of the Southern District of Alabama. The case was investigated by the Department of Homeland Security, Homeland Security Investigations, Immigrations and Customs Enforcement, and Foley Police Department.

Assistant U.S. Attorney Kacey Chappelear prosecuted the case. This prosecution is part of Operation Take Back America, an initiative of the Department of Justice aimed at combating illegal immigration, dismantling cartels and transnational criminal organizations, and safeguarding communities from violent crime.
