The United States Attorney's Office for the Eastern District of Oklahoma has reported that Nicholas Hammer, aged 46, has pled guilty to one count of failure to register as a sex offender. Hammer, previously residing in Tahlequah, Oklahoma, is facing a potential sentence of up to ten years in prison.
The indictment claims that Hammer was convicted of first-degree rape on January 4, 2001, in Oklahoma and that he is obliged to register as a sex offender. Hammer allegedly failed to fulfill this requirement from October 10, 2024, to November 4, 2024, while entering, leaving, or living in Indian country within the Eastern District of Oklahoma.
An investigation into Hammer's failure to register was conducted by the United States Marshals Service alongside the Cherokee Nation Marshal Service.
Hammer's guilty plea was accepted by U.S. Magistrate Judge D. Edward Snow in the United States District Court for the Eastern District of Oklahoma. Judge Snow has ordered a presentence investigation report. Hammer will remain in the custody of the United States Marshals Service until his sentencing.
The final sentencing will be determined by a U.S. District Court Judge, who will consider the U.S. Sentencing Guidelines and other legal factors.
