Mexican national charged with child pornography possession at US border

Alan Xavier Cabrera, a 27-year-old Mexican national, was arrested on April 25 and charged with possession of child pornography. The U.S. Immigration and Customs Enforcement is leading the investigation.

The criminal complaint states that Cabrera attempted to enter the United States at the San Luis, Arizona port of entry using a B1/B2 travel visa. Customs and Border Protection officers examined his cell phone due to his behavior and discovered numerous suspected images of child pornography, also referred to as Child Sexual Abuse Material. Homeland Security Investigations special agents were then called in for further action.

If convicted, Cabrera faces a maximum penalty of up to 20 years in prison, a $250,000 fine, or both. He could also face supervised release for life.

It is important to note that a criminal complaint is merely a method of charging someone with criminal activity and does not imply guilt. Cabrera is presumed innocent until proven guilty beyond a reasonable doubt by evidence presented to a jury.

The prosecution is being handled by the United States Attorney’s Office in the District of Arizona, Phoenix.
