Derek Harvey, a 36-year-old resident of Baltimore, Maryland, has been sentenced to 78 months in federal prison. The sentence was handed down by U.S. District Judge Matthew J. Maddox for possession of a firearm and ammunition by a prohibited person. Following his prison term, Harvey will undergo three years of supervised release.
The sentencing was announced by Kelly O. Hayes, U.S. Attorney for the District of Maryland, alongside Special Agent in Charge Toni M. Crosby from the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF).
The case against Harvey began on January 26, 2024, when a Baltimore City Police Department detective observed a gun exchange via a Citi Watch Camera (CCTV) on Milton Avenue. The detective saw Harvey and his co-defendant Robert Jackson involved in the exchange as they walked southbound on North Milton Avenue.
According to reports, Jackson retrieved a tan handgun from his hoodie and handed it to Harvey, who then placed it in his waistband. Both men were arrested shortly after this observation by BPD detectives who seized the firearm and ammunition. Due to their prior felony convictions, both individuals were prohibited from possessing such items.
This case is part of Project Safe Neighborhoods (PSN), an initiative that unites law enforcement at all levels with communities to reduce violent crime and gun violence while making neighborhoods safer. On May 26, 2021, the Department launched a strategy to strengthen PSN focusing on fostering trust within communities, supporting community-based violence prevention organizations, setting strategic enforcement priorities, and measuring outcomes.
U.S. Attorney Hayes expressed gratitude towards the ATF and BPD for their assistance in the investigation and thanked Special Assistant U.S. Attorney Kertisha Dixon for prosecuting the case.
