On May 6, 2025, a federal grand jury in Louisville issued a superseding indictment against three men accused of conspiring to murder a federal witness. The defendants, Anyelle Curtley Sr., Delrico Nelson, and Antoyne Penick, are charged with conspiracy to tamper with and retaliate against a witness by killing.
U.S. Attorney Michael A. Bennett of the Western District of Kentucky announced the charges alongside Special Agent in Charge Jim Scott of the DEA Louisville Field Division, Acting Special Agent in Charge Olivia Olson of the FBI Louisville Field Office, and other law enforcement officials.
The indictment alleges that between December 28, 2023, and January 31, 2023, Curtley Sr., Nelson, and Penick planned to kill Victim 1 to prevent their testimony in an official proceeding. They also allegedly sought retaliation for information provided by Victim 1 to law enforcement.
Curtley Sr. and Nelson are further accused of aiding each other in murdering Victim 1 using a firearm while assisting a federal investigation.
This indictment follows previous charges from March 5, 2024, where Curtley Sr. and others were indicted for drug trafficking and firearms offenses. The earlier charges involved conspiracy to distribute methamphetamine, fentanyl, cocaine, and money laundering.
The case is part of Operation Take Back America which aims to combat illegal immigration and transnational criminal organizations. It involves multiple agencies including the DEA, FBI, HSI, ATF, IRS-CI, and local police departments.
Assistant U.S. Attorneys Frank Dahl and Josh Porter are leading the prosecution with support from paralegal Aaron Cooper.
All defendants are presumed innocent until proven guilty beyond a reasonable doubt in court.
