Supreme Court ruling on IRS powers raises concerns among small business advocates

NFIB expressed disappointment following the U.S. Supreme Court's decision in Commissioner of Internal Revenue v. Jennifer Zuch. The ruling overturned a lower court's decision that had previously prevented the IRS from bypassing taxpayer rights. Beth Milito, Vice President and Executive Director of NFIB’s Small Business Legal Center, commented on the implications of the decision: “This decision will allow continued abuse of administrative authority and deny taxpayers the rights granted to them by Congress.” She further stated that it could embolden the IRS to act against small business taxpayers without allowing them recourse before asset seizure.

The case revolved around whether the IRS could use a tax refund to settle an alleged tax debt, effectively nullifying any legal challenge against such debt.
