Darnell Ney, a 41-year-old resident of Attica, New York, has been indicted by a federal grand jury for failing to register as a sex offender after moving to Pennsylvania. The announcement was made by the United States Attorney’s Office for the Middle District of Pennsylvania.
Acting United States Attorney John C. Gurganus stated that the indictment alleges Ney did not comply with the Sex Offender Registration and Notification Act (SORNA) requirements from July 22, 2024, until around February 2, 2025. Upon relocating to the Middle District of Pennsylvania, Ney reportedly failed to register his new address as mandated by SORNA.
The investigation into this matter was conducted by the United States Marshals Service (USMS), along with the Wyoming County Sheriff’s Department and the Wyoming County District Attorney’s Office in Warsaw, New York. Assistant United States Attorney Tatum R. Wilson is leading the prosecution.
If convicted, Ney faces a maximum penalty under federal law of up to 10 years in prison, followed by supervised release and a possible fine. Sentencing will be determined by a judge who will consider federal sentencing statutes and guidelines.
It is important to note that indictments are merely allegations. All individuals charged are presumed innocent until proven guilty in court.
