Mexican national sentenced for unlawful reentry; faces removal proceedings

Tulsa, Okla. – U.S. District Judge Gregory K. Frizzell has sentenced Jose Luis Moreno-Yanez, a 39-year-old Mexican national, for unlawful reentry of a removed alien. Moreno-Yanez received a 78-month prison sentence, with three years of supervised release to follow. The judge mandated that 39 months of this federal sentence run consecutively to his existing state sentences for unrelated crimes. Upon completing his sentence, Moreno-Yanez is expected to face removal proceedings.

"While Moreno-Yanez is unlawfully in the United States, his criminal history shows that he commits acts of violence," said U.S. Attorney Clint Johnson. "He has no regard for the laws in the United States and continues to show that he is a threat to lawful citizens. I commend the work of State and Federal prosecutors and law enforcement for working hard to keep our communities safe."

In May and June 2023, Moreno-Yanez illegally re-entered the United States and was charged in two separate state cases for robbery with a firearm. He pleaded guilty in both cases and was also convicted of possessing a controlled drug, assault and battery, among other charges. He received concurrent sentences of 18 years and 20 years from the Oklahoma Department of Corrections. Additionally, due to his illegal re-entry while under federal supervision, he pleaded guilty in federal court for violating the terms of his supervised release, resulting in an additional 24-month imprisonment order by a federal judge.

The case was investigated by U.S. Immigration and Customs Enforcement and Removal Operations, with Assistant U.S. Attorney David D. Whipple prosecuting.
