Brazilian national indicted for illegal reentry into the United States

A Brazilian national living in Weymouth has been indicted for reentering the United States illegally after being deported. Josimar Fernandes-Pessoa, 38, faces one count of unlawful reentry of a deported alien.

The indictment states that Fernandes-Pessoa was removed from the U.S. in 2019 after being caught near the U.S.-Mexico border in Texas. Before his removal, he pleaded guilty to improper entry by an alien in the Western District of Texas. It is alleged that he unlawfully returned to the United States after his 2019 deportation.

The charge carries a potential sentence of up to two years in prison, one year of supervised release, and a fine up to $250,000. Fernandes-Pessoa could be deported again after serving any sentence imposed. Sentences are determined by a federal district court judge based on U.S. Sentencing Guidelines and statutes.

The announcement was made by United States Attorney Leah B. Foley and Patricia H. Hyde, Field Office Director of U.S. Immigration and Customs Enforcement’s Enforcement and Removal Operations in Boston. Assistant U.S. Attorney David Cutshall is prosecuting the case.

The details in the charging documents are allegations at this stage, and Fernandes-Pessoa is presumed innocent until proven guilty beyond a reasonable doubt.
