The White House has announced new measures in response to ongoing threats posed by the Government of the Russian Federation. The action comes as part of continued efforts to address what U.S. officials describe as an "unusual and extraordinary threat" to national security and foreign policy, stemming from Russia's actions regarding Ukraine.
According to the order, previous executive actions, including Executive Order 14066 from March 2022, had already prohibited certain imports from Russia, such as crude oil and petroleum products. The administration states that recent information from senior officials confirms that these threats persist.
As a result, President Donald J. Trump has directed the imposition of an additional ad valorem duty of 25 percent on articles imported from India. This decision is based on findings that India is directly or indirectly importing oil from Russia. The new tariff will apply to goods entering U.S. customs territory for consumption beginning 21 days after the date of the order, with specific exceptions for goods already in transit before that time.
The order outlines how these duties will be applied in addition to existing tariffs unless other legal exemptions are met. It also allows for further modifications if circumstances change or if there is retaliation against the United States as a result of this action.
Monitoring responsibilities have been assigned to several agencies. The Secretary of Commerce, in coordination with other senior officials, will determine whether other countries are importing Russian oil and may recommend similar actions against those nations if necessary.
The Secretary of State is tasked with monitoring developments related to the emergency and consulting with relevant officials about possible further steps if current measures prove ineffective or if there is retaliation by Russia or affected countries.
Implementation authority under this order has been delegated among various departments and agencies, including the Department of State, Department of Homeland Security, U.S. Customs and Border Protection, and others.
President Trump stated: "I have received additional information from various senior officials on, among other things, the actions of the Government of the Russian Federation with respect to the situation in Ukraine. After considering this additional information, among other things, I find that the national emergency described in Executive Order 14066 continues and that the actions and policies of the Government of the Russian Federation continue to pose an unusual and extraordinary threat to the national security and foreign policy of the United States."
He added: "To deal with the national emergency described in Executive Order 14066, I determine that it is necessary and appropriate to impose an additional ad valorem duty on imports of articles of India, which is directly or indirectly importing Russian Federation oil."
Further adjustments to this order may be made based on future recommendations or changes in circumstances involving Russia or impacted countries.
