Portland man appears in court after alleged assault on federal officer near ICE office

A Portland resident appeared in federal court following allegations of assaulting a federal law enforcement officer near the U.S. Immigration and Customs Enforcement (ICE) office in South Portland.

Devin P. Montgomery, 49, faces a felony charge for allegedly assaulting a federal officer. According to court documents, on September 4, 2025, Federal Protective Service (FPS) personnel observed Montgomery operating a drone within a temporary flight restricted area around the ICE facility. FPS officers informed Montgomery that flying drones in this area was prohibited under restrictions set by the Federal Aviation Administration. Despite these instructions, Montgomery reportedly continued to operate the drone.

Federal officers approached Montgomery, who then became confrontational and used profanities toward them. After being arrested, he is accused of spitting in an officer’s face.

Since June 13, 2025, authorities have charged 26 individuals with various federal offenses at the ICE building. These charges include assaulting federal officers, arson, possession of destructive devices, and damaging government property.

Montgomery appeared before a U.S. Magistrate Judge and was released pending further proceedings.

Felony assault of a federal officer carries a potential sentence of up to eight years in prison.
