EPA grants Texas control over underground water protection

The U.S. Environmental Protection Agency (EPA) has approved Texas' request to manage permitting for Class VI underground injection wells under the Safe Drinking Water Act (SDWA). This decision allows Texas to oversee Underground Injection Control (UIC) programs for all well types, enhancing coordination and efficiency. The move aligns with the EPA's Powering the Great American Comeback Initiative, which emphasizes clean water and energy growth.

Scott Mason, Regional Administrator, said, "Approving Texas’ request to be in charge of this critical program is a big step forward for cooperative federalism—as big as the state of Texas." He noted that the Railroad Commission of Texas is prepared to incorporate Class VI wells into its UIC program.

Railroad Commission Chairman Jim Wright expressed gratitude towards the Trump Administration and EPA leaders for their collaboration. He said, "Obtaining Class VI primacy marks an important step forward for our state’s energy sector and our citizens."

Senator John Cornyn praised the approval, saying it gives Texas more control over its permitting process. Senator Ted Cruz emphasized that this decision confirms the Railroad Commission's capability in managing well permits.

Congressman Brian Babin highlighted Texas' leadership in energy development and Congressman John Carter called it a win for Texas' environment and economy. Congressman Dan Crenshaw pointed out that granting states authority over Class VI wells reduces review times and bureaucratic hurdles.

The EPA's comprehensive review concluded that Texas meets all requirements for approval under SDWA. The final rule will take effect 30 days after publication in the Federal Register, though delays are expected due to funding issues.
