A Honduran national living illegally in Philadelphia has been sentenced to seven months in prison for possessing a firearm as a felon. United States Attorney David Metcalf announced that Marvin Enrique Pena-Portillo, 38, received the sentence along with two years of supervised release from United States District Judge Mia Roberts Perez.
Pena-Portillo was arrested in April 2025 on a criminal complaint and warrant. He was charged by information in June and pleaded guilty in July, waiving prosecution by indictment.
According to court documents and the defendant’s admission, ICE and ATF agents arrested Pena-Portillo on April 15, 2025, for immigration violations. At the time of his arrest, he had a loaded 9mm semiautomatic pistol in his waistband.
In August 2024, Pena-Portillo pleaded guilty in the Philadelphia Court of Common Pleas to carrying an illegal firearm in public and was sentenced to two years of probation for that offense.
United States Attorney David Metcalf stated: "This case is part of Operation Take Back America, a nationwide initiative that marshals the full resources of the Department of Justice to repel the invasion of illegal immigration, achieve the total elimination of cartels and transnational criminal organizations (TCOs), and protect our communities from the perpetrators of violent crime."
The investigation was conducted by ICE Enforcement and Removal Operations and the ATF. Assistant United States Attorney Robert Eckert prosecuted the case.
