Nowata man sentenced to nearly 19 years for sexual abuse of minors

A Nowata man has been sentenced to nearly 19 years in federal prison for sexually abusing two teenage girls, according to an announcement from U.S. Attorney Clint Johnson.

Kaleb Scott Smith, 34, received a sentence of 228 months in prison and will be subject to 15 years of supervised release following his incarceration. Upon release, Smith must also register as a sex offender.

A jury found Smith guilty in November 2025 on charges of Sexual Abuse of a Minor in Indian Country and two counts of Abusive Sexual Contact with a Minor in Indian Country. The victims were 13 and 14 years old at the time of the abuse.

Testimony during the trial revealed that in September 2024, one of the victims disclosed the abuse to her parent. The parents contacted law enforcement and provided officers with evidence, including a photograph showing Smith with their daughter under a blanket. In the image, Smith’s arm is wrapped around the child with his hand on her upper thigh.

The victim testified about an incident where she stayed overnight at Smith’s home for his birthday celebration in July 2024. She stated that Smith flipped her waistband and touched her buttocks. The next morning, he showed her a photo of himself naked.

Further testimony described another incident at a casino hotel room where both Smith’s daughter and the minor victim said that Smith cuddled with the minor under a blanket and rubbed his crotch against her back. When she moved to another bed, he followed and continued the behavior.

A third incident occurred when three girls stayed at Smith’s house in September 2024. Testimony indicated that Smith was alone with one victim in his bedroom with the door closed; another girl entered briefly but left after feeling uncomfortable upon seeing Smith on top of the victim. Later that night, more abuse took place. DNA evidence presented at trial linked both Smith's bodily fluids and the minor victim's DNA on his bed.

During interviews with law enforcement, another girl disclosed inappropriate behavior by Smith toward her when she was 13 and again after turning 14, including comments about her body and unwanted physical contact.

Smith is identified as a member of the Osage Nation. He was taken into custody by U.S. Marshals during trial proceedings and will remain detained until transferred to federal prison.

The investigation was conducted by the Bartlesville Police Department and FBI. Assistant U.S. Attorneys Alicia Hockenbury and Matthew Cyran prosecuted the case.
