A Salvadoran national, Helmer Osmin Gutierrez, was sentenced on March 11 in U.S. District Court in Bangor for entering the United States after previously being removed from the country.
U.S. District Judge John A. Woodcock, Jr. sentenced Gutierrez, age 43, to time served. Gutierrez had been incarcerated since October 18, 2025.
According to court records, a Farmington Police Department officer stopped a vehicle for a traffic violation in October 2025. A U.S. Border Patrol Agent responded to assist with identifying the four men inside the vehicle and conducted a field immigration inspection. The agent determined that Gutierrez was a citizen of El Salvador without legal documentation to be in the United States. Immigration records showed that Gutierrez had been removed from the country twice before: once in May 2008 at Miami, Florida and again in May 2010 at Chandler, Arizona.
The case was investigated by U.S. Customs and Border Protection with assistance from the Farmington Police Department.
This prosecution is part of Operation Take Back America, described as a nationwide initiative using resources of the Department of Justice to address illegal immigration and related criminal activity.
