House subcommittee reviews permitting process for tribal natural resource development

The Subcommittee on Indian and Insular Affairs held an oversight hearing on Apr. 22 to examine the federal permitting process for developing natural resources in Indian Country and to discuss ways to make it more efficient. Subcommittee Chairman Jeff Hurd said that tribal leaders have raised concerns about the current system, which they say does not function as intended.

Hurd said, “Today’s hearing is an opportunity to address a concern I hear consistently from tribal leaders: when it comes to developing natural resources on tribal lands, the federal system is not operating as it should. Tribes are prepared to develop their resources and strengthen their economies, yet they are too often met with delays, duplicative reviews and a lack of clear accountability in the federal process. Our focus should be on making that process more predictable and more efficient. That means improving coordination across agencies, providing greater certainty for projects and ensuring that federal actions respect tribal decision-making. When we get that right, it leads to tangible outcomes—job creation, increased local revenue and stronger, more self-sustaining communities across Indian Country.”

Development of natural resources by tribes is seen as an issue of sovereignty because it enables them to create jobs and generate revenue needed for essential government services within their communities.

Tribal lands contain important energy and mineral resources; however, progress has been slowed by what was described as a fragmented approval process involving several agencies and numerous steps. This complexity can cause delays that discourage investment in projects that might otherwise move forward.

Legislation such as Chairman Bruce Westerman’s Standardizing Permitting and Expediting Economic Development (SPEED) Act along with executive orders from President Trump—including EO 14154 (“Unleashing American Energy”), EO 14156 (“Declaring A National Energy Emergency”), EO 14213 (“Establishing the National Energy Dominance Council”), EO 14241 (“Immediate Measures to Increase American Mineral Production”), and EO 14261 (“Reinvigorating America’s Beautiful Clean Coal Industry”)—have aimed at streamlining permitting processes for tribes by reducing duplication among agencies. However, committee members indicated there may still be opportunities for further reform.
