On Wednesday, October 12 at 10:00 a.m., the U.S. House Committee on Education and the Workforce, chaired by Rep. John Kline (R-MN), will hold a legislative hearing on the Workforce Democracy and Fairness Act (H.R. 3094). The hearing will take place in room 2175 of the Rayburn House Office Building.
In June, the National Labor Relations Board (NLRB) issued a notice of proposed rulemaking that will alter the rules governing union elections. Most notably, employers will have just seven days to prepare a case to present before an NLRB hearing officer and workers may have as little as 10 days to decide whether or not to join a union.
Additionally, in its recent Specialty Healthcare decision, the board abandoned the traditional standard for determining which group or “unit" of employees will participate in the union. This will empower union leaders to manipulate the workplace to their own advantage, a significant shift in policy that will divide employees and raise an employer’s labor cost.
Through several oversight hearings, the committee has received testimony concerning the negative impact these recent actions will have on workers and employers. In response, Chairman Kline introduced the Workforce Democracy and Fairness Act (H.R. 3094), legislation that restores years of labor practice and reaffirms protections workers and employers have received for decades. Wednesday’s legislative hearing will allow members to examine and obtain public feedback on the proposal.
