WASHINGTON - Today, House Education and Labor Committee Republican Leader Virginia Foxx (R-NC), Senate Health, Education, Labor, and Pensions Committee Republican Leader Richard Burr (R-NC), Rep. Rick Allen (R-GA), and Sen. Mike Braun (R-IN) sent a follow-up letter to National Labor Relations Board (NLRB) Chairman Lauren M. McFerran expressing continuing concerns over Members Gwynne Wilcox’s and David Prouty’s previous employment with the Service Employees International Union (SEIU), which has created clear conflicts of interest as the Board considers matters related to joint employment policy and SEIU litigation.
In the letter, the Members write: “In our October 13 letter, we requested that you secure in writing ‘the intent of both Member Prouty and Member Wilcox to recuse themselves from all Board activity regarding joint employment policy…’"
The Members state: “In your December 7 response, you again declined to provide the materials we requested… your response said you might consider a request to provide access to information, but only tentatively and conditioned on the conclusion of the SEIU lawsuit through an in camera review. This nod toward some future accommodation is unsatisfactory as it allows Members Wilcox and Prouty to deliberate on joint employment policies through the conclusion of SEIU’s lawsuit. This is clearly a conflict of interest that will taint the proceedings."
The Members also demand an immediate in camera review of the documents requested.
