Republican Leader of the Education and Labor Committee Virginia Foxx (R-NC) gave the following statement in response to the Senate’s failed cloture vote on President Biden’s nomination of David Weil to run the Wage and Hour Division at the Labor Department:
“David Weil’s open hostility to economic opportunity and innovation represents the worst impulses of Washington. As we know from his previous stint with the Department of Labor during the Obama administration, Dr. Weil’s radical out-of-touch agenda poses a sizable threat to the viability of hundreds of thousands of small businesses and promotes the interests of union bosses at the expense of worker rights. Thankfully, his confirmation suffered a potentially fatal blow after a bipartisan group of Senators blocked his nomination from proceeding. Weil’s confirmation would have inevitably subverted the role of Congress and workers’ freedom by implementing elements of the PRO Union Bosses Act through regulation and executive fiat. Independent contracting and franchising would have been under direct threat from the nationwide implementation of California’s discredited ABC test and the Obama-era joint-employer standard.
“A track record of promoting and adopting extreme policies that eliminate pathways to success for millions of hardworking Americans while simultaneously lining union bosses’ pockets should disqualify anyone from federal service. The Senate has spoken and I call on President Biden to nominate an individual who will ensure that the future of our free-enterprise system remains bright.”
