United States Attorney Brendan V. Johnson announced that a Fort Thompson, South Dakota man has been indicted by a federal grand jury for Felon in Possession of a Firearm, Possession with Intent to Distribute a Controlled Substance and Firearm Offense.
Samuel Redwater, age 22, was indicted on Jan. 16, 2013. Redwater appeared before U.S. Magistrate Judge Mark A. Moreno on Jan. 25, 2013 and pled not guilty to the indictment. The maximum penalty upon conviction is 10 years of imprisonment, $250,000 fine, or both; 5 years of supervised release and an additional 3 years of supervised release upon revocation. Restitution and a $100 special assessment may also be ordered. The charges are merely accusations, and Redwater is presumed innocent until and unless proven guilty.
The investigation is being conducted by the Federal Bureau of Investigation and Assistant United States Attorney Kathryn N. Rich is prosecuting the case. Redwater was remanded to the custody of the U.S. Marshals. A trial date has not been set.
